Having a single, harmonised set of end-of-waste criteria and applying it uniformly across the EU will help deliver an efficient single market for secondary raw materials. By clarifying when obligations from current waste legislation cease to apply to plastic waste, the new criteria will reduce the administrative burden on economic operators.

The Commission has produced a draft regulation with the related annexes stipulating that plastic waste will cease to count as waste when:

  • it is used as input for mechanical or solvent-based recycling operations and can then be used directly in the production of new products, and
  • the producer or importer completes the Statement of conformity for each consignment of plastic recyclate and implements a quality management system demonstrating compliance with the end-of-waste criteria.
